New law gives tenants in foreclosed homes additional protection

If you buy a foreclosed home that has an existing tenant in it you need to be sure you are aware of and comply with  provisions of the “Helping Families Save Their Homes Act of 2009″.  The act went into effect on May 20, 2009 and provides the following protections for the existing tenant:
  • For the act to apply the tenant must be under a “Bona Fide Lease or Tenancy” which the act describes as:
    • the tenant is not the mortgagor or the child, spouse or parent of the mortgagor
    • the lease or tenancy was the result of an arms-length transaction, and
    • the lease or tenancy requires the receipt of rent that is not substantially less than fair market rent for the property or the unit’s rent is reduced or subsidized due to a Federal, State or local subsidy
    • tenancy or lease was in effect as of the date of the “notice” of foreclosure Read more…

HUD's Housing Choice Voucher Program alert…

 A couple of weeks ago I made a post about renting property under Housing Choice Voucher program and offered it as something you may want to consider.  Included in my post was reference to the fact that in order for your property to be eligible for this program it had to meet some basic HUD’s standardsI myself have rented properties through this program and prior to it’s existence,  HUD’s Section 8 program, for years and never really had a problem meeting HUD’s standards for the housing.

Subsidized Rentals to Low-Income Families

You may already be renting your homes to one or more of the 1.95 million families that receive rental assistance under HUD’s Housing Choice Voucher program, however if not you may want to consider doing so.

What is the Housing Choice Voucher programThis is a program that was established in 1974 and known as “Section 8″ to assist lower income famlies, the elderly and the disabled to afford decent, safe and sanitary housing in the private market.  Subsequently there have been several changes to the program including in 1998 when Congress combined the then two existing Section 8 rental programs into theHousing Choice Voucher Programas is in use today.  For this article I’m just going to focus on the low-income family aspect of the program but will discuss the other applications of the program in future articles.
